The third hearing in the case against Mabel Matiz, who is being tried on charges of “obscenity,” was held today. The hearing was postponed to May 8.
The third hearing in the case filed against Mabel Matiz on charges of “obscenity,” based on his song Perperişan, was held today at the Istanbul 54th Criminal Court of First Instance.
According to the Media and Law Studies Association (MLSA), the prosecutor, in their final opinion, requested that Matiz be punished.
In the opinion, the prosecutor argued that Matiz’s lyrics “evoke connotations through bodily and spiritual metaphors.” Claiming that the lyrics are “contrary to public morality,” the prosecutor stated that they “contain depictions related to sexual intercourse” and that such content was made available on platforms accessible to children.
Matiz’s lawyers requested additional time to prepare their defense against the prosecutor’s final opinion.
The hearing was postponed to May 8 at 11.00 a.m.
What was in the indictment?
The indictment argued that expressions in the song “indirectly incite sexual desire, include erotic connotations through bodily and spiritual metaphors, and contain depictions related to sexual intercourse.” It emphasized that these depictions are understandable by the general public and claimed that making the song available without age restrictions poses a risk to children. The indictment seeks a prison sentence of between six months and three years for Matiz on the charge of “facilitating the dissemination of obscene content.”
At the first hearing, the judge asked Matiz, “Was this song written for a man?” Matiz responded: “I find this question upsetting and hurtful. You would not have asked this if an arabesque singer had performed it. Anyone can sing for anyone.”
